What You Should Do Right Away If You've Been Injured

It helps to take certain steps as soon as possible if you or a loved one has been hurt as a result of someone else's negligence. Victims of catastrophic injury, wrongful death and medical negligence are often facing enormous challenges. If you have lost a family member, or been hurt yourself, try to follow these tips:

  1. Get appropriate medical care and follow the medical advice. If you are not happy with the treatment or advice, seek another doctor right away. Many injuries can be lessened by early treatment.
  2. Build a good support team. Get friends and family members to assist you. Many serious injuries make even the most basic tasks, like getting to and from doctors' appointments, difficult or impossible. Truly catastrophic injuries or deaths may also be worthy of public benefits, or require significant paperwork and arrangements. You will need help looking into and accomplishing all of these matters.
  3. Start writing things down. Record dates and times of incidents, and the names and involvement of any witnesses. It can take a year or more for a serious injury claim to get to trial, and you do not want to forget or lose important information.
  4. If you think someone else is at fault, find the right lawyer. Look for specific experience handling similar claims, and ask whether the case will remain with that attorney or be referred to another. Ask the attorneys how long it takes for them to resolve most of their cases. Ask whether the primary lawyer stays personally involved, or hands the case off to a subordinate. Check the firm's track record, and ask around about a firm or lawyer's reputation. Finally, consider interviewing multiple attorneys to find the one that makes you most comfortable.
  5. Don't delay. You only have a certain amount of time before you must make a decision to pursue a legal claim. In addition, delay can result in lost evidence or witnesses, so it is almost always best to get started as soon as you can.
